That's bullshit. Everyone in radio has to play by the same FCC rules as Howard. Other radio shows figured out how to make a great radio program within those guidelines why can't howard? Why could he make a great radio show in the 80's and 90's with FCC guidelines but he can't in the past few years?
the man has thrown in the towel and is looking for his last big pay day. Have fun paying for 4 days a week of radio and 12 weeks of vacation. I think that's less the 6 months of actual radio.
Yes in theory, everyone has to play by the rules. The reality is that the more people listen to your show, the more likely you are to be punished. Do you know how the FCC works? They don't monitor every brodcast out there. The largely rely on listner complaints. Every complaint is extrapilated into a listner percentage. Its like one complaint would represent the 10,000 people offended. So 10 people call in you got 100,000 complaints. My ratio might be wrong but this is the general concept.
Stern was nationally sydicated in probably hundreds more radio markets than the next closest "shock jock". The more people that listen to you, the more likely you will get a complaint. Howard has not really changed. The FCC has gotten more agressive in there inforcement. However, Stern's main problem was with his employers. Infinity Brodcasting was tired of the FCC fines. They are the one who actually pulled in the reigns. He had already been dumped by Clear Channel in '04. If he had a boss who was willing to back him up and challange the FCC in court, he probably would have stayed on the public air waves.
Question back to you Shroom - Who are those other successful "shock jocks" on public air? Keep in mind O/A and Bubba the Love Sponge were canned so they don't count.
BTW, I'm not saying Sirius got a fair deal.

Stern was never sydicated into hundreds of markets
If you read up on it, Stern has been sydicated in about 35-40 markets accross the country. Sean Hannity and Rush Limbaugh are sydicated into over 400 markets. Stern has only been syndicated in BIG CITY'S that can afford him. In reality Stern going to Siruis will be his first "National show"
As for other "shock Jocks" there are only a few that have/had actual syndication deals. Lykis, Don and Mike, O&A, Imus and Mancow are the only other ones that had major sydication deals close to Sterns. Bubba had 3 or 4 markets and same with Lex and Terry, Bob and Tom and Mark and Brian
As for "succesful shock jocks" Bubba was never one. He was syndicated in only a few markets. As for O&A they were not canned by the FCC, they were canned by Infinity because the religious right was up their ass about the "Sex For Sam Stunt". Some other jocks are Lex and Terry, Imus and Don and Mike. They have the sames rules.
It's funny how O&A made a name for themselves in the same 10 years Stern was doing sub-par radio even though they both had the same FCC rules.

Should have said this earlier. I am not a Stern fan. However, I do respect what he has accomplished. He is a radio personality is a niche market. Those other jocks... do they have a best selling autobiography? A crappy Hollywood movie about their lives? Cable TV shows? News media drooling over them. No!!! Eventhough he feels he is subpar, everyone keeps throwing money and attention at him. Sirius is taking a gamble that I would never had made. If Stern doesn't deliver the subscribers, Sirius is done.
