My brother's in trouble...Any suggestions?

My brother was arrested yesterday because of 'kiddie porn' pics found on his pc hard drive that was taken in for repair more than a year ago. He was reported to police by the repair shop about a month after he took the pc in. He has cooperated fully with a detective assigned to the investigation, and they formally charged him yesterday. He spent the night in jail, and is now out on bond.

He has been told that he has to prove that he did not know that the pics (over 1,000) where there. The pc had began running slowly and locking up, and he did not know why. I had advised him to run virus protection programs to find the problem, and it found several, but did not detect an apparent hijacking of his hard drive space.

His arrest was carried as lead story on the 6 o'clock news at home because he is a high school teacher, which will certainly damage his career, even though he hasn't been convicted of anything.

Does anyone have any advice for his defense? There must be ways to show that his pc could be used for storing illegal pics without his knowledge. He has an attorney, and I have suggested that they consult a pc expert in order to examine this possibility. Any help would be appreciated. Thanks in advance...

work with computers "fixing them" im i technician and pics like that dont just get "put" on your machine by someone ulse through the net it would of been him.

I haven't ever heard of a virus that hi-jacks your hard drive space for storage?

maybe give him the benefit of the doubt (i know its hard to believe, but maybe it happened, do you check every folder every day, i know i dont and now i'm a little nervous)

i really dont know much about computers and hacking and stuff, i wish you the best though if he's truly innocent

yeah I agree aye, unless one day some dude broke into his house and uploaded a thousand pics onto his pc and then gapped it.

sounds sus to me.. but if he is innocent than have faith in the law system..

i saw on CSI the other day a chapter about a guy who got an email with a virus and that virus started to open millons of those pics

Kiddie porn just doesn't end up on one's computer like nothing......I've worked in IT for some time as well as law enforcement. I've heard all the excuses..

Sorry but your brother is fucked and he's gonna have to get a real good lawyer and he's gonna have to prove his side which rarely happens in this case.

The other possibility to your brother's problem could be if he was in a file sharing network and "allowed" someone to have access to his PC. Though even this could be a stretch to some it can be done. Afterall, some tech problems are handled over the Internet. Had he installed some firewalls properly he might not have this problem. I would be suspect of the computer repair shop too, some people think playing a joke of this type is funny, but it's not. Also you have to pay attention to your system and what's on there and who uses it. In my house nobody is allowed on it without my consent and it's locked down when I head out of town.

Then again, nobody has all of the evidence in front of them at this time so thus nobody is able to make a solid, intelligent and logical judgement. So please, watch your comments and try to put yourself in this guy's shoes.

However, if he is into kiddie porn than don't bring him around me. I have no use for this type of crap. And neither does the long list of my friends with kids.

your brother needs a really good lawyer with a record defending people in these type of cases, he needs to get into someone kind of treatment program for his illness (cuz that's what it is), he needs to get testimonials from friends, family and colleagues about his character, and he needs to get every computer out of his house now, although i am sure the cops already took care of that. as your brother, you will of course accept what he says, but other people won't, as evidenced by the reaction of WBWers to his excuse. and you might want to get used to the idea that your brother is going to prison.

1000 pics on your hdd is not an accident.... sorry.

He must've been doing somthing that mad them suspicious in the first place.
