My brother's in trouble...Any suggestions?

This is singularly the most disturbing post I've ever read. I'm disturbed if he is guilty and I'm equally disturbed if he isn't. What if you had a person that didn't like you entered your home or office and opened up an illegal child porn site and downloaded it on your computer and then later called the FBI on you?
There are two lessons I learned from this posting: 1) Never visit a kiddie porn site and 2) even if you don't visit them and your computer needs repair-----throw the motherfucker away and buy a brand damn new one and start over.

I think this story sounds fishy, but I know that filesharing networks look around your hd for files to share (if you allow that) so it seems possible that someone could gain access to your computer and deposit files there. The matter for this guys brother will be to prove that which is going to be hard without a PC/Internet expert and even then will be tough unless the person was really stupid. I would also be suspicious of the repair shop. As was stated by others, he should check the dates of the files and he should investigate every person in that shop and find out what kind of security the shop has. Could an employees friend have gotten access to the computer? Could anyone have gotten access to the computer while at the shop? Could anyone have gotten access to the computer while it was in his home? If this brother is a teacher his career is probably over no matter how this turns out. What school district is going to want to hire a teacher that has gone through something like this and what school district would want to try to explain to Jimmy and Jenny's parents how they could have hired a teacher that was accused of being a pedophile? At least (if he's innocent) he might be able to avoid jail or the registered sex offender route.

If he is really innocent then he is going to need the support of hsi family but I definately wouldn't be leaving kids alone with the man regardless.

Also if you think about it, 1000 pics on your computer would take how long to download? Maybe twenty minutes if they were all in one folder to begin with and he is on a broadband connection? Thats not a feature length movie we are talking about here. But I would definately have them look into the date created as well as possibly tracking info on where they came from. Suddenly having a folder pop up named "kiddie porn" on my computer would make me raise an eyebrow, especially if it had already been acting funny enough for me to want to take it to the shop.

Personally, I think he is guilty as sin. However, you are looking to help your brother and I can understand that.He needs help, but for god's sake don't get it until this is over. Any attempt to seek help now would be tantamount to a guilty plea. His best bet is the "broken trail of evidence". That PC shop and all it's employees should be fully investigated. He's a teacher? Any of their kids, or any ties what-so-ever to a kid who goes to his school, could be a reason to fuck with your brother. You need to have reasonable doubt to find him "not guilty". Note...I said "not guilty", not "innocent", there is a difference. You also need to get a jury consultant to hopefully slant things in his favor. Remember, it only takes one of twelve to believe in him (or not believe the prosecution). Money should be no object as this is going to fuck with his whole life if it turns against him. Also, credibility is a huge issue. You need to make your brother look like a saint and have as many character witnesses as possible (who themselves are beyond reproach).You need to destroy the PC shop employees, the detectives (any juror should be sceptical of overzealous police work).As far as expert testimony from a computer expert, "baffle them with your bullshit".Most laypeople (who will be on the jury) don't understand shit about computers and what is possible. Note...I said "possible", not "likely". If it is possible, It has to raise doubt.
Most importantly, get an attorney who can make a powerful closing argument. That is what this will come down to in the end.You need to make everone on the jury believe this "could" happen to them. They need to be hesitant to convict your brother because the penalties are too high if they are wrong and unjustly convict him. In our justice system, from what I've seen and read, a person with a few dirty pictures of kids accidently in his possesion is treated the same as a person convicted of actually raping or molesting a child, who is treated the same as the 18 year old who got caught screwing his 16 year old girlfriend.They are all sex offenders and pedophiles, once they are convicted. The glitch is that there are various degrees of offenses, but only one punishment.
If actually guilty, your brother needs to consider the possibility of "getting the hell out of Dodge".If he is convicted, and he probably will be if he's guilty, his life will never be the same and will probably become intolerable. His punishment will be for life - it will be on his record. Maybe he should spend his money on creating a new identity and moving to Costa Rica. It's still a life sentence, but at least he can walk the streets without being stoned. And for God's sake! DON'T EVER DO IT AGAIN.

i dont thing any of the repair people have anything to do with it unless they have a serious grudge against him. as far as ANYONE storing anything on his computer, with that many files, they would obviously want to access them again. so look for any type of software that lets someone else access the computer remotely. there are plenty of trojan viruses out there that give you remote access to another computer. and again, check the creation dates. but to be honest, unless some sort of evidence is found that his computer has been remotely accessed, he's screwed. .... good luck though. i hope the truth sets him free/ or puts him way.

Actually, since this isn't a capital crime, the jury can come back with a majority verdict. This means he has to convince at least 7 of them.

If I were him I'd pray I wasn't the best looking guy on the cell block and hope the other inmates don't find out what he's in for.

Like cleaning the jail floor or picking up the soap.

Sorry just had to get that out my system. Sounds like he`s fucked to me, i`m sure pc experts have been through his computer by now to check for download dates and traces of hacks. I dont think they would take the case too far if there was a chance he didnt download the files.

People have gotten away with incidental stuff time and again. The police and DA would have made sure he was actually looking for the stuff. If he downloaded it, then his best bet is to ask for mercy and say he is sick and needs help. He will still have to register and probably give up his internet access, but he may be able to get out of spending too much time in jail, especially if it was not stuff he created. They do make a distinction between people who actually take the pictures or are in the pictures, and people who download them. Especially if the downloader asks for help.
