Well, if the girl wouldn't want her pictures posted, then yes, there is a moral conflict and you're a douchebag for doing it. Unless there are sever extenuating circumstances, which, in all but a very very few cases, there arent.

The answer is NO you can't publish any pics or videos without express consent for release. If you do you'll be liable on a civil action against you. Even with the consent you can be challenged in courts about how valid that consent is (is the person a minor, was it taken under the influence of any substances, etc...)

But about the morals...raise your hands those here that have never opened a thread that included the word girlfirned on it

Well, Half of WBW and most of the internet would not exist without people posting pics of their exes. A good example is Girls gone Wild, Before they never asked if they could use it and now every clip has a disclaimer question in it. Posting clip or pictures with out permission is wrong, but very few people on here and others sites are innocent of it, just look at the majority of the avatars for proof of that. I've never posted private pictures I've taken of my Lady but then I haven't broken up with Her.

All in all, in this digital age, I'm surprised there isn't a national law about it.

As long as they are of legal age and consented to have pix/videos shot, it's cool. best way to get permisson is to verbalise in video How do you like being a ___yr old porn star baby? If they respond positively you got em right by the toochee!!!! With pix have them autograph pix along with a comment on how they love being photoed naked for sll to see or something like that. This shows their consent.

To get real legal have em sign a release. You can google performance release or appearance release and download forms and guidelines.

If you don't have permission, then you shouldn't do it.
Anytime a realationship ended I either gave the pics/vids back or destroyed the nude ones.
I figure you never know when your place will be robbed or worse.
I have a friend that she and her husband had some naughty pics stashed away and after their house burned
down after a lighting strike, several months later her pics showed up on the internet. Turned out one
of the fireman found them when sorting thru the fire and junk and stole them. THey were taken off and the
fireman was fired but I know that stuff never goes away once out on the net. I figure sooner or later her
pic might show up here if its not already in the galleries somewhere.

I always have thought in to be hilarious that you can't degrade women on this site, but you can post pictures of your ex without their permission. Not that I don't look. I just think it is funny.

I can't see myself ever posting any of the nude pictures I have of ex-girlfriends. That's just not something I would do to another person.

As far as the legallity issue, it seems to be a pretty grey area in the US. A lot of court battles have been fought in recent years involving celebrity sex tapes. I'm not sure of all of the outcomes, but it proves that even in high profile cases there isn't a clear cut answer. As far as the "no sound" issue it concerned, I believe that stems from laws that many states have saying that you can't covertly record audio of a person who is unaware. A lot of these laws hadn't been updated a few years ago for video recording, but now more states are changing things. Incidents like tanning salon voyeurism tends to help push legislation through that prohibits video recording a person without their knowledge in a place that they can reasonably expect privacy. That is a whole different area, though.

i love how people try to justify doing a shitty thing on this site. people will do anything to make an excuse to say what they're doing is right. it's never ok to take an ex's pictures and put them on the internet unless they give consent to it in a clearly defined WRITTEN AGREEMENT that they KNOW their nude or sex photos with be placed on the internet for the entire world to see. until then, what you're doing is fucked up. end of story. you can't just assume that because someone is comfortable enough to be sexual with you, that they deserve to be exploited. i see the person placing the photos online as a person making an excuse, which they hope will justify them being an asshole. it just plain makes you an asshole, in my eyes.

There are several laws in the United States which protect an individuals' right to privacy. They are in the defamation family. It is not "illegal," but you can be sued in civil court. It doesn't matter if you have permission when the photos were taken, you must have permission to publish the photos.

Usually, you need to have the person IN the picture sign a release otherwise, those materials could legally be said to be for private use only and the publication of such materials after the fact is illegal. But how many stupid ex's know that one!!

I thought that was only if you were using the pictures to make a profit or sell an item or service. If you were using the pictures in a commercial to sell a product or in a video you are going to sell you need a signed release. If you are just sharing the pictures with some friends and not makeing any money off of it as long as you own the pictures you can post them. If she knew you were taking the pictures (no hidden cameras) and you took them with your camera and have them you are free to share them with no penalties. Thats how I understand it.
