Fraud car builder (need help)

My dad was having a 1950 ford pick up completely rebuilt by a shop in Lafayette, La. The guy the owns the place promised him that it would be done by a certain date and that it would cost approximately $50,000 no more than $60,000.
Every time we went to check on it no one seemed to be working on it, but my dad was getting charged for labor. 7 other cars came and went since they started on his truck. 2.5 years later and over $100,000. The truck is supposedly complete.
They ask my dad if they can show it in the car show for him in Houston,Tx. for thanksgiving show '08.
My dad agree's. They completed the truck and trailered it the next day straight to the show. My dad shows up @ the show unexpectidley, they had registered like they were they owner of the truck not the builder. Well when they get back they said they had a few miner adjustments to make then he could pick it up before Christmas. He went a few days before Christmas to pick it up, the guy test drove it down the block then loaded it in the trailer for him. Dad took it out for Christmas to show the family for the first time. And nothing worked, none of the guages, none of the electric stuff, etc.. So he starts it drives it down the street about a block, and the transmission starts knocking back. He loads it back on the trailer. The guy had removed the power cord that plugs into the engine and all the dip sticks for the oils,engine ,transmission etc.. When my dad called him to tell him about it, he said that it is not road ready yet, and he can't get his parts untill he pays another $35,000. And that no one can can work on his truck due to him having that special power cord for the motor(lightning motor)?? And now he is threatening to reposess the truck for the bogess $35,000. We have now found out that he has done this to numerous other people, and he has reposessed one comaro (that we now of) and that guy had already spent $200,000 then he wanted more $. We have contacted a lawyer with the camaro guy. But is there anything we can do not to have his truck reposessed?? Any comments will be appreciated!!

i second this, posession is 9/10s of the law... get a lawyer and go after them... i don't think they can go over the ammount you agree to without your consent...they can't just keep billing you and doing things without your ok... i would get a lawyer right away and look into the laws of your state...

Not sure I'd keep the truck depending on how much you've got invested. Hiding the truck won't do you any good because if the title is in his name, that's all the police are going to care about initially when they come to you saying that you either give back the car or they throw your ass in jail for grand theft auto. Hopefully before getting into something this expensive, you had the foresight to have a contract drawn up? At any rate, good job getting a lawyer, and I suggest you follow his council. If you're worried about the guy skipping town or something, maybe suggest that the car be held by a 3rd party (or in the police impound) until things are sorted out.

did he actually buy the actual truck itself from this guy? or did you dad buy it and then TAKE it to this guy for repairs?


if he didnt actually buy it from this guy, then he has no right to repossess it. do you have a garage with a door? i suggest parking it in there until you all get it sorted :P

from what i can tell, it is his dad's truck and he was having it rebuilt... they can get a mechanics lean, but if it's in your posession it's harder to get... also, like i said they can not go over the agreed amount without your permission in most states...

I agree with Fathertime.In my state, and probably all states, only vehicles with bank loans or liens get be reposessed.
He released the car to you, so if he claims you owe him money he will have to either sue you or get a mechanics lien.The lien just means you can't sell the truck.Check your contract to look at the fine print.

Keep the truck. Get a lawyer.
